Welcome to Sense for Scents. By accessing or purchasing from our website (senseforscents.com), you agree to be bound by the following Terms of Service. Please read these terms carefully before placing an order. These terms are intended to protect both you as a customer and the integrity of our products and services.

2. SCOPE OF APPLICATION

These Terms of Service apply to all orders placed through our online store.

By placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, Refund Policy, and Shipping Policy.

These terms apply to both consumers (persons acting for purposes outside their trade, business, or profession) and business customers.

 

3. GENERAL CONDITIONS

3.1 Right to Refuse Orders

We reserve the right to refuse or cancel orders for justified reasons, including but not limited to:

  • Suspected fraud or unauthorized use of payment methods
  • Products no longer available or discontinued
  • Pricing or product description errors
  • Inability to verify customer information
  • Violation of these Terms of Service
  • Unusual or bulk orders that exceed personal use quantities

If we cancel your order after payment has been processed, you will receive a full refund.

3.2 Product Authenticity

  • All perfume decants are hand-filled from original, authentic fragrances purchased through authorized channels.
  • We source our fragrances from legitimate retailers and distributors.
  • Each decant is prepared with care to maintain fragrance integrity.

3.3 Brand Disclaimer

  • We are an independent fragrance decanting service.
  • We do not claim affiliation with, sponsorship by, or endorsement from any fragrance house or brand unless explicitly stated in writing.
  • All brand names and trademarks are the property of their respective owners and are used solely for descriptive purposes to identify the products we decant.

3.4 Intellectual Property

You agree not to:

  • Reproduce, duplicate, copy, sell, resell, or exploit any part of our products, content, or website without written permission
  • Use our product descriptions, images, or branding for commercial purposes
  • Reverse-engineer or attempt to replicate our business model or processes

All content on this website, including text, graphics, logos, images, and product descriptions, is the property of Sense for Scents and is protected by German and international copyright laws.

 

4. CONTRACT CONCLUSION

4.1 Product Presentation

The presentation of products on our website constitutes an invitation to make an offer (invitatio ad offerendum), not a binding offer.

4.2 Order Process

  1. You add products to your shopping cart
  2. You review your order and may correct any input errors
  3. You proceed to checkout and enter required information
  4. You review the complete order summary, including total price
  5. You submit your order by clicking "Complete Order" or similar button
  6. You receive an automated order receipt email (this is not yet a binding acceptance)

4.3 Contract Formation

A binding purchase contract is concluded when:

  • Your payment has been successfully processed, and
  • You receive an order confirmation email from us

We reserve the right to decline orders before sending the order confirmation email.

4.4 Contract Language

The contract language is English. The contract text (including these Terms of Service) will be stored and made available to you via email.

4.5 Correction of Input Errors

Before submitting your order, you may review and correct your entries (products, quantities, shipping address, payment method) via the shopping cart and checkout pages.

 

5. PRODUCTS AND AVAILABILITY

5.1 Product Range

We offer hand-filled perfume decants in the following formats:

  • 5 ml glass vials with atomizer
  • 10 ml glass vials with atomizer

We do not sell full-size bottles unless explicitly stated on specific product pages.

5.2 Product Descriptions

We provide detailed product descriptions, including:

  • Fragrance house and name
  • Fragrance notes and olfactory profile
  • Available sizes and pricing
  • Seasonal recommendations (where applicable)

While we strive for accuracy, please note:

  • Fragrance perception is subjective and may vary by individual
  • Scent development may be affected by skin chemistry, climate, and storage
  • Product images are for illustrative purposes and may not reflect exact appearance

5.3 Availability

  • Products are offered in limited quantities based on our current inventory.
  • Availability depends on sourcing from original fragrance manufacturers and authorized distributors.
  • We reserve the right to limit quantities per customer to ensure fair access.
  • If a product becomes unavailable after you place an order, we will contact you to offer alternatives or a full refund.

5.4 Product Changes

We reserve the right to:

  • Discontinue products at any time
  • Update product descriptions, images, or formulations as manufacturers make changes
  • Adjust pricing (see Section 6)

 

6. PRICING AND PAYMENT

6.1 Currency and Prices

  • All prices are displayed in EUR (Euro).
  • Prices include all applicable costs and are final.
  • As a Kleinunternehmen under Section 19 UStG, we do not charge VAT (value-added tax).

6.2 Shipping Costs

  • Shipping costs are calculated separately and displayed during checkout before you complete your order.
  • Shipping costs vary based on destination and selected shipping method.

6.3 Total Price

The total price payable (including all costs and shipping) is clearly displayed during checkout before you submit your order.

6.4 Price Changes

  • Prices may be changed at any time without prior notice.
  • The price applicable to your order is the price displayed at the time you complete checkout.
  • Price errors: If we discover a significant pricing error after you place an order, we will inform you and give you the option to proceed at the correct price or cancel the order with a full refund.

6.5 Payment Methods

Payments are processed securely via Shopify Payments and its certified payment service providers, which may include:

  • Credit cards (Visa, Mastercard, American Express)
  • Debit cards
  • PayPal
  • Apple Pay / Google Pay
  • Other payment methods as displayed at checkout

6.6 Payment Processing

  • Payment is due immediately upon order placement.
  • We do not ship orders until payment has been successfully processed and verified.
  • Your payment information is processed directly by our payment service providers in compliance with PCI-DSS security standards.
  • We do not store complete credit card information.

6.7 Payment Issues

If payment fails or is declined:

  • Your order will not be processed

7. ORDER PROCESSING AND FULFILLMENT

7.1 Order Confirmation

Upon successful payment, you will receive:

  1. An immediate order receipt email (payment confirmation)
  2. An order confirmation email (contract acceptance) within 24 hours

7.2 Preparation Time

  • Orders begin processing shortly after confirmation.
  • Decants are prepared individually by hand, which requires careful attention.
  • Processing time is typically 1-3 business days before shipment.

7.3 Shipping

  • Once your order ships, you will receive a shipping confirmation email with tracking information (where available).

7.4 Cancellation of Orders (Before Shipment)

  • Due to the individual preparation process, orders begin processing quickly.
  • If you wish to cancel an order, contact us immediately at info@senseforscents.com
  • We will do our best to accommodate cancellation requests before shipment, but cannot guarantee cancellation once preparation has begun.
  • Your statutory right of withdrawal (see Section 8) remains unaffected.

 

8. RIGHT OF WITHDRAWAL (EU CONSUMERS ONLY)

8.1 Withdrawal Right

If you are a consumer located in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days from the day:

  • On which you (or a third party other than the carrier indicated by you) acquire physical possession of the goods
  • For multiple goods ordered in one order and delivered separately: on which you acquire possession of the last good

8.2 How to Exercise Your Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision by a clear statement (e.g., email, letter):

To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period expires.

8.3 Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for supplementary costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw.

We will use the same means of payment as you used for the initial transaction unless expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earliest.

8.4 Return of Goods

You must send back or hand over the goods to us without undue delay and in any event no later than 14 days from the day you communicate your withdrawal.

The deadline is met if you send back the goods before the 14-day period expires.

You bear the direct cost of returning the goods.

8.5 Your Responsibility for Diminished Value

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

This means:

  • You may open and inspect the product to determine what it is
  • You may not use the product extensively
  • Opened fragrance vials that have been used beyond testing may result in a deduction from your refund

8.6 Exceptions to Right of Withdrawal

The right of withdrawal does not apply to:

  • Goods that are unsealed after delivery and are not suitable for return due to health protection or hygiene reasons (if extensively used)
  • Goods that are clearly personalized or custom-made to your specifications

Note: While fragrance decants can generally be returned if opened only for inspection, we reserve the right to refuse refunds for products that have been extensively used or contaminated.

 

9. DELIVERY AND RISK TRANSFER

9.1 Delivery Terms

  • Delivery times are estimates displayed during checkout and in our Shipping Policy.
  • We ship to addresses within the EU and select international destinations (see Shipping Policy).
  • Delivery times begin after payment confirmation and order processing.

9.2 Risk Transfer (Consumers)

For consumer orders, the risk of loss or damage during transit remains with us until the goods are delivered to you (or to a third party designated by you, other than the carrier).

Exception: If you have selected a carrier not offered by us, risk transfers when we hand the goods over to that carrier.

9.3 Risk Transfer (Business Customers)

For business customers, risk transfers when goods are handed over to the shipping carrier.

9.4 Delivery Issues

If your order is lost or damaged during shipping:

  • For consumer orders: We will resolve the issue at no cost to you
  • We will work with carriers to file claims and arrange replacement or refund

 

10. USE OF PRODUCTS

10.1 Intended Use

Our perfume decants are intended for personal use only, including:

  • Personal fragrance exploration
  • Testing before purchasing full bottles
  • Building a personal fragrance collection
  • Gifts for friends and family

10.2 Prohibited Uses

You may not:

  • Resell, redistribute, or commercially exploit our decants
  • Repackage or rebottle fragrances under your own branding
  • Use decants for any commercial purpose without written permission
  • Misrepresent the source or authenticity of the fragrances

10.3 Safety Information

  • Fragrances contain alcohol and should be kept away from heat and flame
  • Store in a cool, dry place away from direct sunlight
  • Keep out of reach of children and pets
  • Discontinue use if irritation occurs
  • Consult a physician if you have allergies or sensitivities

10.4 Age Restriction

You must be at least 18 years old to purchase from our store.

By placing an order, you confirm that you meet this age requirement.

 

11. WARRANTY AND LIABILITY

11.1 Statutory Warranty (Gewährleistung)

As a consumer, you have statutory warranty rights under German and EU law (§§ 437 ff. BGB).

  • We are liable for defects that exist at the time of delivery.
  • The statutory warranty period is 2 years from delivery.
  • If a product is defective, you may demand repair, replacement, price reduction, or (in certain cases) rescission of contract.

11.2 Product Quality

We warrant that our decants:

  • Contain authentic fragrances from original bottles
  • Are filled carefully in sanitary conditions
  • Are properly sealed and labeled

We do not warrant:

  • That you will enjoy the scent (subjective preference)
  • That the fragrance will perform identically on all skin types
  • That reformulations by manufacturers won't affect scent profiles

11.3 Exclusions from Warranty

Warranty does not cover:

  • Normal wear, evaporation, or aging of fragrances
  • Damage caused by improper storage (heat, light exposure)
  • Allergic reactions or skin sensitivities
  • Damage caused by misuse or failure to follow instructions
  • Products purchased from unauthorized resellers

11.4 Limitation of Liability

We are liable without limitation for:

  • Intentional acts or gross negligence
  • Injury to life, body, or health
  • Claims under the Product Liability Act (Produkthaftungsgesetz)
  • Breach of fundamental contractual obligations (Kardinalpflichten)

For slight negligence:

  • We are liable only for breach of essential contractual obligations
  • Liability is limited to foreseeable, typically occurring damages
  • Liability for indirect damages, consequential damages, and lost profits is excluded

11.5 Specific Disclaimers

We are not liable for:

  • Allergic reactions, skin irritation, or adverse reactions to fragrances
  • Misuse of products
  • Damage to clothing or property from fragrance application
  • Subjective dissatisfaction with scent profiles

If you have known allergies or sensitivities, check ingredient lists (available upon request) before ordering.

11.6 Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, strikes, transportation disruptions, or supplier issues.

Our website may contain links to third-party websites for informational or reference purposes (e.g., fragrance house websites, fragrance databases).

  • We do not control or endorse third-party websites.
  • We are not responsible for their content, data practices, or availability.

We use third-party services for:

  • Payment processing (Shopify Payments, Stripe, PayPal)
  • Shipping and fulfillment (Deutsche Post, DHL, etc.)

13. GOVERNING LAW AND JURISDICTION

13.1 Governing Law

These Terms of Service and all contractual relationships between you and Sense for Scents are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

13.2 Consumer Protection

If you are a consumer:

  • Mandatory consumer protection laws of your country of residence remain unaffected.
  • You benefit from any mandatory provisions that provide greater protection than German law.

13.3 Jurisdiction

For disputes with consumers, the statutory provisions on jurisdiction apply.

For disputes with business customers, the exclusive place of jurisdiction is Munich, Germany, if you are a merchant, a legal entity under public law, or a special fund under public law.

 

14. DIGITAL COMMUNICATION

By placing an order, you agree to receive communications from us electronically, including:

  • Order confirmations
  • Shipping notifications
  • Customer service responses
  • Important updates regarding your order

Electronic communications satisfy any legal requirement that such communications be in writing.

You may opt out of marketing communications (if we introduce them) but cannot opt out of transactional emails related to your orders.

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions remain in full force and effect. The invalid provision shall be replaced by a valid provision that comes closest to the economic intent of the invalid provision.
